A simple Trump tweet on a subject does make it a legal act. He was advocating that was not constitutional legal.
Edit: There was no legal precedent for what Trump was advocating. Constitutional scholars of which Pence has access to, said it was not the VP’s power. That is the very definition of advocating for something not legal. Once again Trump tweets don’t automatically become truth or law just because he want it to be that way.
