Subject: Filling an unused stock pond

Buddy of mine is wanting to fill in an old stock pond that hasn't been used since he put in a well, pipeline and trough system through EQIP about 10 years ago. However, when he asked the local NRCS office about this he was told he that it was not allowed. I've seen dozens of dug ponds in the area filled in and farmed over because a dug pond was considered an Artificial Wetland and not subject to sod/swamp rules. The only explanation I can come up with is that NRCS has a wetland designation on surrounding area but not sure about that. I've been online and can't find anything dealing with requirements on abandoning or filling in artificial wetlands. There were two different contacts with NRCS personnel and both said not allowed. Unless it is in a designated wetland (landowner says it is not) I don't understand why. Any suggestions? TIA
